En amerikansk konkursrettsforvalter planlegger å stenge ned konspirasjonsteoretikeren Alex Jones’ Infowars-medieplattform og likvidere eiendelene for å betale 1,5 milliarder dollar i søksmålsdommer Jones skylder for gjentatte ganger å ha kalt Sandy Hook Elementary School i 2012 for en bløff.
I et «nødstilfelle» inngitt søndag i Houston, indikerte bobestyrer Christopher Murray offentlig for første gang at han har til hensikt å «gjennomføre en ryddig avvikling» av driften til Infowars’ morselskap og «likvidere dets varelager.»
Murray, som ble utnevnt av en føderal dommer til å føre tilsyn med eiendelene i Jones’ personlige konkurssak, ga ingen tidsplan for likvidasjonen.
Jones har sagt på nett- og radioprogrammene sine at han forventer at Infowars vil operere i noen måneder til før det legges ned på grunn av konkursen.
Men han har lovet å fortsette sine bombastiske sendinger på en annen måte, muligens på sosiale medier. Han hadde også snakket om at noen andre kjøpte selskapet og lot ham fortsette showene sine som ansatt.
Murray ba også den amerikanske konkursdommeren Christopher Lopez om å sette et øyeblikkelig grep om Sandy Hook-familienes innsats for å samle inn det enorme beløpet Jones skylder dem. Murray sa at denne innsatsen ville forstyrre planene hans om å stenge morselskapet, Free Speech Systems i Austin, Texas, og selge sine eiendeler – med mye av inntektene til familiene.
Fredag ba advokater for foreldrene til et av de 20 barna som ble drept i skytingen i Newtown, Connecticut, en delstatsdommer i Texas om å beordre Free Speech Systems, eller FSS, til å overlate visse eiendeler til familiene, inkludert penger i bank. kontoer, og pynte på kontoene. Dommer Maya Guerra Gamble godkjente forespørselen, viser rettsprotokollen, noe som førte til Murrays nødstilfelle.
Foreldrene, Neil Heslin og Scarlett Lewis, hvis 6 år gamle sønn, Jesse Lewis, ble drept i skytingen, vant en dom på 50 millioner dollar i Texas over Jones’ løgner om at skytingen var en bløff iscenesatt av kriseaktører med målet å øke våpenkontrollen. I et eget Connecticut-søksmål ble Jones beordret til å betale andre Sandy Hook-familier mer enn 1,4 milliarder dollar for ærekrenkelse og følelsesmessig nød.
Med henvisning til familienes innsamlingsinnsats, sa Murray i søndagens saksbehandling at «Spøkelset av et pell-mell beslag av FSSs eiendeler, inkludert kontanter, truer med å kaste virksomheten i kaos, og potensielt stoppe den i sporene, til skade» av hans plikter i Jones’ personlige konkurssak.
«Tillitsmannen søker denne domstolens inngripen for å forhindre et verdiødeleggende pengegrep og la en ryddig prosess gå sin gang,» sa Murray.
Murray ba også dommeren om å avklare sin autoritet over Jones’ bankkontoer. Som en del av Jones ‘personlige konkurssak ble hans eierskapsrettigheter til FSS overført til Murray. Jones har fortsatt sine daglige sendinger i mellomtiden.
Det var ikke umiddelbart klart når konkursdommeren ville behandle Murrays forslag.
Konkursadvokater for Jones, Heslin og Lewis returnerte ikke umiddelbart meldinger som søkte kommentarer mandag.
Christopher Mattei, en advokat for Sandy Hook-familiene i Connecticut-søksmålet, sa at de støttet bobestyrerens nye forslag. Han sa også at familiene var skuffet over forslaget som ble inngitt fredag i Texas-domstolen av Heslin og Lewis, som han sa ville «underby» en rettferdig fordeling av Jones’ eiendeler til alle familiene.
«Dette er nettopp den uheldige situasjonen som Connecticut (søksmål) familiene håpet å unngå,» sa Mattei.
Familiene i begge rettssakene, som ikke har mottatt noe fra Jones ennå, ser ut til å få bare en brøkdel av det Jones skylder dem.
Jones har rundt 9 millioner dollar i personlige eiendeler, ifølge de siste økonomiske registreringene i retten. Free Speech Systems har rundt 6 millioner dollar i kontanter og lagerbeholdning til en verdi av rundt 1,2 millioner dollar, ifølge nylige rettsvitneforklaringer.
Den 14. juni godkjente Lopez, konkursdommeren, å konvertere Jones’ personlige konkurssak fra en omorganisering til en likvidasjon, noe Jones ba om. Lopez avviste også omorganiseringskonkurssaken til FSS, etter at advokater for Jones og Sandy Hook-familiene ikke kunne bli enige om en endelig konkursplan.
Konkurssakene hadde satt et automatisk grep om familienes innsats for å samle inn noen av de 1,5 milliarder dollarene, i henhold til føderal lov. Avskjedigelsen av FSS-konkursen betydde at familiene måtte flytte denne innsatsen fra konkursdomstolen til delstatsdomstolene i Texas og Connecticut hvor de vant de juridiske dommene.
Jones og Free Speech Systems begjærte konkursbeskyttelse i 2022, samme år som slektninger til mange ofre for skoleskytingen som drepte 20 førsteklassinger og seks lærere vant rettssakene sine.
De pårørende sa at de var traumatisert av Jones’ lurekonspirasjoner og hans følgeres handlinger. De vitnet om å bli trakassert og truet av Jones’ troende, hvorav noen konfronterte de sørgende familiene personlig og sa at skytingen aldri skjedde og at barna deres aldri har eksistert. En forelder sa at noen truet med å grave opp hans døde sønns grav.
Jones anker dommene til de statlige domstolene. Han har sagt at han nå tror at skytingen skjedde, men ytringsfriheten tillot ham å si at det ikke skjedde.
