En dømt migrantvoldtektsmann på livstids prøveløslatelse som klarte å bli i USA takket være lovlige smutthull, vil endelig bli sendt hjem, har The Post fått vite.
Van Phu Bui brakk hodeskallen til en Bronx-mann i 2022 med et brutalt sug. Bui, 56, som nå soner for den grufulle forbrytelsen, vil bli deportert tilbake til sitt hjemland Vietnam så snart han er løslatt fra fengselet, fortalte en amerikansk immigrasjons- og tollmyndighet til The Post denne uken.
Bui kom til USA i 1985 gjennom Seattle og søkte asyl. Seks år senere var han i Big Apple og arrestert for første gang for forsøk på ran, bekrefter online rettsprotokoller.
Ytterligere detaljer om hendelsen var ikke umiddelbart tilgjengelig.
En immigrasjonsdommer beordret Bui fjernet fra USA 5. februar 1991, sa ICE.
Men Bui ble ikke oppstartet på grunn av en lov fra 1990 som skjermet migranter fra deportasjon til land som står overfor naturkatastrofer eller krig.
Så Bui slo seg ned i Claremont i Bronx, hvor han voldtok en tenåringsjente med våpen på julaften i 1994. Han ble dømt i 1995 og dømt til 6 år til livstid, til slutt sonet 20.
Likevel klarte ikke tjenestemenn å deportere ham i 2015, takket være en avtale fra 2008 som ekskluderte vietnamesiske statsborgere som ankom USA før 1995 fra å bli repatriert.
«Han burde vært fjernet for lenge siden,» sa en ICE-kilde til The Post på betingelse av anonymitet.
Så, i august 2022, kalte Bui – nå hjemløs – Jesus Cortes Cabrera uten forvarsel utenfor Fuego Tipico Restaurant i Fordham Manor. Cortes Cabrera, som underviser barn i meksikansk dans, tilbrakte tre uker på sykehuset med alvorlige hjerneblødninger og et hodeskallebrudd.
Saken vakte overskrifter etter at politiet siktet Bui for drapsforsøk, bare for å få Bronx District Attorney’s Office til å nedgradere siktelsen til overgrep. Bui ble dømt i mai og fikk 3 1/2 til 7 års dom.
Når Buis nåværende dom er sonet, vil han endelig bli sendt hjem igjen, insisterte tjenestemenn, takket være nylig avslappede hjemsendelsesavtaler som først ble initiert i 2019 av Trump-administrasjonen.
«Han vil være i stand til å fjernes fra USA til Vietnam etter fullført fengselsstraff,» sa ICE og la til Bui har gått med på å ikke kjempe mot deportasjon.
Cortes Cabrera sa at det var skuffende å lære om Buis flere tiår gamle deportasjonsordre.
«Jeg hadde håpet at han ble deportert første gang, så han ikke ville ha skadet meg,» forklarte Cortes Cabrera. «Det burde ikke ha skjedd. … Det er et mirakel at jeg er i live.»
Cortes Cabrera sa at Bui fortjente mer fengsel enn han fikk.
«[If] denne fyren tilbringer tre år i fengsel og så deporterer de ham til Vietnam, jeg vil at han skal bli i fengsel i Vietnam, sa Cortes Cabrera. «Han er veldig, veldig dårlig, og han vil gjøre det samme der. Jeg tror ikke han vil endre seg.»
Buis advokat var ikke nådd for kommentar.
