Justisdepartementet har saksøkt eiendomsteknologifirmaet RealPage for angivelig å tillate utleiere å bruke programvaren deres til ulovlig samarbeid for å heve husleie for leietakere over hele landet.
Bombesøksmålet – anlagt sammen med åtte stater: California, Colorado, Connecticut, Minnesota, North Carolina, Oregon, Tennessee og Washington state – hevder at RealPage hjalp utleiere med å fikse priser som økte månedlige leiepriser for millioner av leietakere.
Justisdepartementet peker på uttalelser fra RealPage-ledere som viser at de innså at de var med på å dempe konkurransen på utleiemarkedet.
«Det er større nytte i at alle lykkes kontra i hovedsak å prøve å konkurrere mot hverandre på en måte som faktisk holder hele bransjen nede,» sa en leder, ifølge justisdepartementet.
Programvaresystemet, YieldStar, ble utviklet for å hjelpe eiendomsforvaltere og utleiere med å maksimere inntektene ved å bruke avanserte algoritmer og dataanalyse for å bestemme optimale leiepriser for leiligheter og andre utleieenheter basert på faktorer som markedstrender, etterspørsel, beleggsrater og konkurrentpriser.
Justisdepartementet hevder at utleiere i hemmelighet deler informasjonen produsert av programvaren for å sette leieprisene høyere enn hva de ville vært i et konkurranseutsatt marked.
Jennifer Bowcock, en talsperson for RealPage, sa til New York Times at selskapets programvare var «med hensikt bygget for å være juridisk kompatibel.»

RealPage blir også anklaget av den føderale regjeringen for ulovlig monopolisering av markedet for eiendomsadministrasjonsprogramvare for flerfamilieboliger i USA.
«Amerikanere burde ikke måtte betale mer i husleie fordi et selskap har funnet en ny måte å avtale med utleiere for å bryte loven,» sa statsadvokat Merrick Garland i en uttalelse.
I oktober 2022 anla leietakere et gruppesøksmål mot RealPage og flere store eiendomsforvaltningsselskaper som ble anklaget for å bruke prisprogramvaren for å øke husleiene i strid med føderale antitrustlover.
I februar i år ble to selskaper som eier og driver flerfamilieboliger enige om å gjøre opp kravene. RealPage har benektet enhver forseelse.
RealPage ble grunnlagt i 1998 av forretningsmannen og gründeren Steve Winn, som forsøkte å skape en plattform som ville strømlinjeforme eiendomsforvaltningsprosesser gjennom bruk av programvare og dataanalyse.
Winn vokste selskapet før det ble børsnotert i 2010, da det ble notert på Nasdaq-indeksen. I 2021 solgte Winn RealPage til private equity-giganten Thoma Bravo i en kontantavtale til en verdi av 10,2 milliarder dollar.
