Metas uavhengige tilsynsråd avgjorde onsdag at det kontroversielle, anti-israelske slagordet «Fra elven til havet vil Palestina være fritt» ikke er hatytringer.
Brukere av Metas Facebook- og Instagram-apper kan fortsette å bruke slagordet i innleggene sine så lenge innleggene ikke inkluderer annen kontekst som glorifiserer Hamas eller oppfordrer til vold, sa styret i en flertallsvedtak.
Slagordet, som jødiske grupper har kritisert som iboende antisemittisk, krever en palestinsk stat som strekker seg over landet mellom Jordanelven og Middelhavet – landet som for tiden er okkupert av Israel.
Noen styremedlemmer var uenige i onsdagsbeslutningen og argumenterte for at uttrykket skulle forstås som en iboende glorifisering av Hamas siden uttrykket dukker opp i Hamas-charteret fra 2017.
Styret så på tre tilfeller der brukere rapporterte innlegg med uttrykket og slo fast at innleggene ikke brøt Metas regler for hatytringer fordi de ikke eksplisitt oppfordret til vold mot jødiske eller israelske folk.
«I stedet inneholder de tre innholdsdelene kontekstuelle signaler om solidaritet med palestinere,» sa styret.
«Vi ønsker velkommen styrets gjennomgang av vår veiledning i denne saken,» sa Meta til The Post i en uttalelse. «Selv om alle retningslinjene våre er utviklet med sikkerhet i tankene, vet vi at de kommer med globale utfordringer, og vi søker regelmessig innspill fra eksperter utenfor Meta, inkludert Oversight Board.»
«Fra elven til havet» er ikke et nytt ordtak, men det har blitt en populær sang ved pro-palestinske protester siden terrorangrepene mot Israel av Hamas den 7. oktober, som førte til Israels bombardement av Gaza-stripen.
Israelske og jødiske talsmenn har forkastet bruken av uttrykket, som Hamas vedtok for å oppfordre til voldelig ødeleggelse av Israel.
«Palestina er vårt fra elven til havet og fra sør til nord,» sa Khaled Mashaal, Hamas’ tidligere leder, i en tale i Gaza i 2012. «Det vil ikke være noen konsesjon på noen tomme av landet.»
Anti-Defamation League sa at den er «respektfullt uenig» i Metas styres avgjørelse.
Ligaen sa at uttrykket er et antisemittisk oppfordring til en palestinsk stat fra elven til havet – som «ville bety avviklingen av den jødiske staten».
«Det er viktig å merke seg at å kreve rettferdighet for palestinere, eller å oppfordre til en palestinsk stat, ikke bør bety, som denne hatefulle frasen antyder, å nekte staten Israels rett til å eksistere,» sa ADL.
Noen palestinske aktivister har sagt at setningen ikke er en oppfordring om å ødelegge Israel, men om palestinsk frihet og likhet etter år med israelsk militærstyre.
Den demokratiske representanten Rashida Tlaib fra Michigan – som ble sensurert av huset i november i fjor – har argumentert for uttrykket.
«Fra elven til havet er en ambisjonell oppfordring om frihet, menneskerettigheter og fredelig sameksistens, ikke død, ødeleggelse eller hat», tvitret Tlaib i november.
Et av innleggene som ble vurdert av Metas styre viste uttrykket laget av flytende vannmelonsymboler. Brukere av sosiale medier har tatt i bruk vannmelon-emojier som et pro-palestinsk symbol.
Innlegget ble sett 8 millioner ganger og rapportert 951 ganger, sa styret.
De to andre sakene ble sett av færre personer.
En var en kommentar som oppmuntret folk til å «snakke opp» om konflikten, og en annen var en del av et innlegg fra en pro-palestinsk organisasjon, sa styret.
«Fordi uttrykket ikke har en enkelt betydning, vil et generelt forbud mot innhold som inkluderer uttrykket, en standardregel for fjerning av slikt innhold, eller til og med bruke det som et signal for å utløse håndhevelse eller anmeldelse, hindre beskyttet politisk ytring i uakseptabelt måter», slo styret fast.
Mer enn 2300 personer og organisasjoner sendte inn kommentarer etter at Meta-styret kunngjorde at de ville vurdere de tre sakene i mai.
Det er det nest høyeste antallet kommentarer styret har mottatt på en saksgjennomgang siden det diskuterte å suspendere tidligere president Donald Trump fra sine plattformer i 2021.
Styret består av journalister, advokater og forkjempere for ytringsfrihet fra hele verden.
I styret sitter til og med Helle Thorning-Schmidt, Danmarks tidligere statsminister.
Meta-sjef Mark Zuckerberg opprettet styret i 2019.
