PHOENIX — America First Legal saksøker Arizonas utenriksminister for ikke å ha frigitt listen over 216 000 velgere, for det meste innbyggere i lang tid som ikke beviste statsborgerskapet sitt under en lov fra 2004, påvirket av en kodefeil.
Strong Communities Foundation of Arizona er en klient av den konservative søksmålsgruppen, og forespørselen om offentlige registre ble avvist.
«Ved å nekte offentlig tilgang til disse journalene, frustrerer de saksøkte kjerneformålet med loven om offentlige registre, å ‘overvåke ytelsen til myndighetene’,» heter det i søksmålet.
«Og fordi disse postene omhandler et presserende spørsmål av umiddelbar offentlig bekymring, er tid av essensen. De saksøkte bør beordres til umiddelbart å oppfylle saksøkers forespørsel om offentlige registre,” fortsetter det, og ber spesifikt om at forespørselen oppfylles innen 7. oktober.
Men utenriksminister Adrian Fontes’ juridiske rådgiver uttrykte bekymring for at å overlevere listen til den ideelle organisasjonen kan føre til velgerskremsel.
«Vi frykter, spesielt basert på SCFs registreringer, at dets sanne ønske her ikke er å holde øye med regjeringens handlinger – som våre offentlige arkivlover er utformet for å lette – men i stedet trakassere og skremme velgere midt i et valg og hvis rettighetssekretær Fontes har allerede rettferdiggjort for Arizonas høyeste domstol,” sa et brev 24. september som forklarer beslutningen om ikke å etterkomme forespørselen.
Arizonas høyesterett avgjorde at velgerne kunne motta en full stemmeseddel gitt hvor nært det var at stemmesedler begynte å bli sendt ut på tidspunktet for avgjørelsen. Opprinnelig var det 98 000 mennesker som antas å være på listen, men totalt 118 000 flere ble oppdaget.
Disse velgerne er i hovedsak fastboende som ikke var blitt bedt om å oppfylle plikten som ble opprettet i 2004 om å vise bevis på statsborgerskap for velgerregistrering. Retten bestemte at de må vise bevis for fremtidige valg. Uavhengig av utfallet, ville det aldri ha påvirket føderale løp, ettersom det ekstra statsborgerskapskravet er et spørsmål om statlig lov.
I en oppdatering torsdag sa Fontes’ kontor at det har sendt fylkesregistratorer gjennom hele statens velgerdata «fra den første» gruppen «med informasjon som vil muliggjøre SAVE-databaseverifisering slik at fylkesregistratorene kan begynne å utføre statsborgerskapsverifisering.» Kontoret sa til The Post at det «ikke kommenterer pågående rettssaker».
Fontes’ kontor sa også at det pågår forsøk på å bekrefte bevis på statsborgerskap med «interne og eksterne kilder» i håp om å forkorte listen. Kontoret reviderte også antallet fra omtrent 218 000 til 216 000.
«Vi må huske på at denne situasjonen skjedde uten feil av de berørte individuelle registrantene,» sa Fontes. «Alle Arizonans berørt av dette problemet forblir stemmeberettigede og er lenge beboere i Arizona. Alle har bekreftet under straff for mened – samme standard som resten av landet bruker – at de er amerikanske statsborgere. Hadde det ikke vært for den unike byrden skapt av implementeringen av Arizonas Prop 200 i 2004, ville dette problemet ikke engang eksistert.»
