Den republikanske statsadvokaten i Louisiana, Liz Murrill, anla et «nødsøksmål» mot flere tjenestemenn i Harris-Biden-administrasjonen forrige uke etter at en kinesisk migrant med en sjelden form for tuberkulose tok seg ulovlig inn i USA.
Søksmålet søker å hindre føderale immigrasjonsmyndigheter i å løslate «potensielt infiserte internerte» som kom i kontakt med den kinesiske statsborgeren – som har en «sjelden, aggressiv og medikamentresistent form for tuberkulose som bærer høy dødelighet» – mens hun var i varetekt av immigrasjon og tollhåndhevelse.
«ICE har kunngjort sin intensjon om å løslate potensielt infiserte internerte fra sine to kontraktsfasiliteter [in Louisiana] – uten å bli godkjent av Louisiana Department of Health – hvis en ordre krever løslatelse, heter det i klagen.
«Etter det ICE sier, er hendene bundet når dens immigrasjonsbaserte interneringsmyndighet går ut», fortsetter søksmålet, og advarer om at migranter som kan ha fått sykdommen vil bli sluppet ut «på gatene i Louisiana, busstasjonene og flyplassene».
«Dette er helt feil,» hevder Murrill. «Kirurggeneralens stående ordre krever at fanger ved de to aktuelle fasilitetene holdes med mindre og til de er medisinsk godkjent av Louisiana Department of Health.»
«Dette er en vesentlig utøvelse av statens suverene privilegier, utøvelsen av dens politimyndigheter og dens forpliktelse til å beskytte folkehelsen innenfor dens grenser,» legger hun til, og bemerker at de to fasilitetene der den infiserte migranten ble holdt ikke eies av IS.
Murrill anslår at over 200 internerte og «utallige antall ikke-fanger» kan ha blitt utsatt for sykdommen da den TB-infiserte migranten ble fløyet av ICE fra California til Louisiana og deretter transportert mellom et interneringssenter og behandlingsanlegg.
Den kinesiske migranten – en kvinne hvis navn er fjernet i søksmålet – krysset ulovlig grensen mellom USA og Mexico i april og ble pågrepet av føderale myndigheter i California i juli, ifølge klagen.
«Minst noen av de rundt 40 fangene som ankom kl [Richwood Correction Center in Monroe, La.] med [her] har siden blitt deportert, overført, flyttet eller løslatt», heter det i søksmålet.
Kvinnen ble gitt en TB-hudtest da hun ankom Richwood som testet «svært positiv» 23. juli.
Et røntgenbilde av thorax viste også tegn på «aktiv tuberkulose», ifølge klagen.
Til tross for tilsynelatende å ha den smittsomme sykdommen, «tre dager senere …» flyttet ICE [her] til South Louisiana ICE Processing Center (‘Basile-anlegget’) i Basile, Louisiana, hvor hun ble plassert i «generell befolkning» – noe som potensielt eksponerte enda flere mennesker for patogenet.
«Det var omtrent 174 fanger ved Basile-anlegget som potensielt ble utsatt for [the woman]hvorav omtrent 60 har blitt deportert, overført, flyttet eller løslatt fra Basile-anlegget,» ifølge søksmålet.
Kvinnen testet positivt på Basile-anlegget igjen i september og ble innlagt på sykehus for «pre-ekstensivt medikamentresistent TB», som Murrill bemerker «er svært resistent mot både første- og andrelinje anti-TB-medisiner, vanskelig å behandle, og har høy dødelighet [between 34%-39%].»
Louisiana fikk ikke vite om den «overhengende trusselen mot folkehelsen» før 9. oktober.
Riksadvokatens søksmål – anlagt 16. oktober og ulukket tirsdag – navngir sekretær for innenlandssikkerhet, Alejandro Mayorkas, ICE-fungerende direktør Patrick Lechleitner, direktør for sentre for sykdomskontroll og forebygging Mandy Cohen og flere andre som tiltalte.
En amerikansk distriktsdommer i Louisiana vil høre argumenter i statens forsøk på å holde migranter ved Richwood og Basile-anlegget i ICE-varetekt inntil de kan bli medisinsk klarert 31. oktober.
«Beskyttelsen av vår sørlige grense er avgjørende for sikkerheten til USA,» sa Murrill i en uttalelse. «Det er verken politisk eller urimelig at Louisiana gang på gang har krevd at Biden-Harris-administrasjonen skal forsvare denne nasjonen.»
«De som ikke er lovlig tilstede bør ikke være i landet – punktum,» la hun til. «Millioner av udokumenterte illegale romvesener fortsetter å strømme over den sørlige grensen – uidentifisert, usporet og uprøvd for sykdommer som kan true livet til amerikanske borgere.»
«Den føderale regjeringen har satt helsen og sikkerheten til Louisiana og amerikanere i fare. Til tross for denne pliktforsømmelse av president Biden, visepresident Harris og sekretær Mayorkas, handlet Louisiana-tjenestemenn umiddelbart for å beskytte vårt folk.»
